The Agency Accountability Act of 2023 requires federal agencies to deposit any fees, fines, penalties, or settlement proceeds into the general fund of the Treasury. However, these funds can only be used if specifically authorized in an appropriations bill. Certain exceptions apply, including payments to whistleblowers, loan guarantee programs, and insurance programs. The U.S. Patent and Trademark Office (PTO) must report annually to Congress on its collected settlement funds, and offsetting receipts and collections will be treated as revenue for budget purposes.
