The Digital Asset Market Structure and Investor Protection Act aims to regulate digital assets and digital asset securities within the United States. It grants the Commodity Futures Trading Commission (CFTC) authority over digital assets, defined as electronically or digitally created assets programmed with rules, capable of decentralized transfer, and subject to anti-money laundering regulations. The Securities and Exchange Commission (SEC) receives similar authority over digital asset securities, which are defined as assets providing equity, debt, voting, or liquidation rights. The bill also addresses digital federal reserve notes, the regulation of digital asset fiat-based stablecoins, and the exclusion of digital assets from federal deposit insurance, while establishing reporting requirements for various aspects of digital asset activity.
