Bill overview
This bill, the Visa Overstay Enforcement Act of 2023, makes it a crime for non-U.S. citizens to remain in the country after their visa or immigration status expires. Individuals convicted of a first offense face a fine or up to six months in prison, and a five-year ban on re-entry to the United States, followed by a ten-year ban on receiving a visa. Subsequent offenses carry penalties of up to two years in prison and a permanent ban on re-entry or visa issuance. The Department of Homeland Security can make exceptions for cases involving medical needs, public safety, or national security concerns.
