The Protecting Our Essential Medicines Act requires the Secretary of Health and Human Services to create and maintain a list of ‘critical drugs’ – medications deemed essential to the U.S. public health supply chain and those whose shortage would negatively impact patients with chronic conditions. This list will include information about the drug’s origin and manufacturing facilities. The bill also mandates the creation of additional lists identifying drugs exclusively produced in or using ingredients from foreign entities of concern and the top three countries from which the U.S. imports these critical drugs. Information on this list will be shared with national security agencies while protecting trade secrets and confidential business information.
