Bill overview
This bill would allow states located within 25 miles of the U.S.-Mexico border to erect temporary protective fencing to deter illegal immigration. It amends the Secure Fence Act of 2006 to define ‘protective fencing’ and establish a prohibition against the federal government removing or interfering with this fencing. The bill also grants the Attorney General the authority to seek court orders requiring states to remove fencing if it’s proven to be intended to facilitate illegal immigration. Essentially, it aims to give states more tools to address border security concerns.
