The Timely Departure Act requires certain nonimmigrants entering the United States to pay a bond or cash payment, ranging from $5,000 to $15,000, to ensure they depart by the end of their authorized stay. If a nonimmigrant overstays their visa, the bond or payment is forfeited, leading to removal proceedings and a period of ineligibility for future immigration status. The bill also mandates that asylum seekers or those seeking withholding of removal must apply for these protections before their visa expires. The Department of Homeland Security will regulate the collection and retention of these payments, notification of the Attorney General, and prevent circumvention of the bond requirement.
