Overview
This bill eliminates the automatic presumption of pretrial release for defendants charged with contempt of a domestic violence restraining order in New Jersey. Currently, the state’s bail reform law allows for release unless the court determines release would reasonably assure the defendant’s appearance in court, protect public safety, and not obstruct the criminal justice process. However, this bill specifically excludes contempt of domestic violence restraining orders from this presumption, and requires a showing of why release should be revoked if a defendant already on release violates a restraining order.
