Overview
This bill clarifies New Jersey’s sentencing guidelines for individuals convicted of first or second-degree crimes. It allows a judge to reduce a sentence to a lower degree crime if they believe mitigating factors significantly outweigh aggravating factors and the interest of justice warrants it. Specifically, if a reduced sentence is imposed, it won’t become final immediately, allowing the prosecution to appeal. This legislation restores language previously removed and applies retroactively.
