Overview
This bill clarifies the sentencing guidelines for defendants convicted of first or second-degree crimes in New Jersey. It allows a judge to reduce a sentence to a lower degree crime if they believe mitigating factors significantly outweigh aggravating factors and the interest of justice warrants it. Specifically, if a reduced sentence is imposed, it won't become final immediately, allowing the prosecution to appeal. This legislation restores language previously removed and is identical to a Senate bill.
