Bill overview
The Protect Act of 2025 expands the authority of Tribal courts to address serious crimes within Indian country. Specifically, it allows Tribal courts to prosecute individuals for controlled substance offenses and firearms offenses, broadening the scope of Special Tribal Criminal Jurisdiction (STCJ). The bill also enables Tribal courts to obtain electronic communications data through warrants, similar to state courts, and clarifies procedures for disclosure of customer communications. Finally, it ensures that offenders convicted under STCJ can be incarcerated through the Bureau of Prisons Tribal Prisoner Program.
